SWEEPSTAKES DESCRIPTION:
The Replica Surfaces Sweepstakes (the “Sweepstakes”) begins on May 24, 2024, at 12:00:01 a.m. Central Time (“CT”) and ends on May 24, 2024, at 11:59:59 p.m. CT (the “Sweepstakes Period”).
Entry in the Sweepstakes does not constitute entry into any other promotion, contest, or sweepstakes. By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Replica Surfaces, located at 1530 P B Lane #G4383, Wichita Falls, TX 76302 (“Sponsor”), which shall be final and binding in all respects.
ELIGIBILITY:
Only legal United States residents residing in the fifty (50) United States and the District of Columbia, which specifically excludes Puerto Rico and U.S. territories and possessions, who are eighteen (18) years of age or older are eligible to enter. Eligible entrants who are less than the age of majority in their state or jurisdiction of primary residence (a ‘minor’) must have a parent/legal guardian’s permission to participate in the Sweepstakes. If a potential winner is a minor in their jurisdiction of residence, they must provide written permission from a parent or legal guardian to receive the prize. Employees, officers, and directors of Sponsor, participating retailers, and their respective parent companies, affiliates, subsidiaries, advertising, fulfillment, and marketing agencies, and immediate family members, and/or those living in the same household of each, are ineligible to enter the Sweepstakes or win a prize. The Sweepstakes is void in Puerto Rico, U.S. territories and possessions, and where prohibited by law.
HOW TO ENTER:
There are two (2) ways to enter the Sweepstakes:
Purchase Method:
During the Sweepstakes Period, place an order on the Replica Surfaces website on May 24, 2024. Each order placed on this day will automatically be entered into the Sweepstakes. If selected as a winner, your order will be refunded up to $300.
Mail-in Method:
To enter without making a purchase, hand-print your full name, complete address, email address, telephone number, and date of birth on a plain 3"x5" piece of paper and mail it in a sealed envelope with proper postage to: Replica Surfaces, 1530 P B Lane #G4383, Wichita Falls, TX 76302. Each mail-in entry must be postmarked by May 24, 2024, and received by May 31, 2024. Limit one (1) entry per stamped outer envelope. Each mail-in entry will receive one (1) entry into the Sweepstakes. If you are selected as a winner via the mail-in method, you will receive $300 in cash.
Limit of one (1) entry per person, regardless of method of entry. Participants may not enter using both methods; doing so will result in disqualification. All entries must be received in accordance with the deadlines stated herein to participate. The Sponsor’s database clock will be the official timekeeper for online entries in this Sweepstakes. In the event of a dispute regarding the identity of the individual who submitted an entry, the entry will be deemed to be made by the authorized account holder of the email address associated with the entry. The Sweepstakes Entities shall not be responsible for incorrect or inaccurate entry information, whether caused by Internet users, equipment, or programming associated with or utilized in the Sweepstakes, or by any technical or human error that may occur in the processing of the entries in the Sweepstakes.
WINNER SELECTION AND NOTIFICATION:
On or about June 7, 2024, two (2) potential prize winners will be randomly selected from all eligible entries received throughout the Sweepstakes Period. The potential prize winners will be notified by email within five (5) business days of the selection using contact information provided at the time of entry. If prize notification is returned as undeliverable, Sponsor is unable to contact a potential winner, or a potential winner is not in compliance with these Official Rules, such prize will be forfeited and, at Sponsor’s discretion, an alternate winner may be selected for the applicable prize. Sponsor shall have no liability for any winner notification that is lost, intercepted, or not received by the potential winner for any reason. Sponsor, in its sole discretion, will attempt to contact up to three (3) potential winners of each prize in accordance with the above procedure, after which the prize in question may go unawarded if it remains unclaimed. If a potential prize winner is found to be ineligible or has not complied with these Official Rules or declines the prize for any reason prior to the award, such potential prize winner will be disqualified and an alternate prize winner may be selected. If a potential winner is an eligible minor in their jurisdiction of residence, Sponsor reserves the right to award the prize in the name of their parent or legal guardian who will be responsible for fulfilling all requirements imposed on the winner set forth herein. The odds of winning depend on the number of eligible entries received throughout the Sweepstakes Period.
PRIZE:
Two (2) Prizes are available:
One (1) prize for a purchase entry: the winner’s order will be refunded up to $300.
One (1) prize for a mail-in entry: the winner will receive $300 in cash.
All federal, state, and local taxes, including income taxes, and any other costs associated with prize acceptance and use not specified herein as being provided, are the sole responsibility of each winner. Winners may be issued an IRS Form 1099 for the value of their prize. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Winners may not substitute, assign, or transfer the prize.
GENERAL:
Entrants agree that the Sweepstakes Entities, to the extent permissible by law (A) shall not be responsible or liable for, and are hereby released from, any and all costs, injuries, losses, or damages of any kind, including, without limitation, death and bodily injury, due in whole or in part, directly or indirectly, to participation in the Sweepstakes or any Sweepstakes-related activity, or from entrants’ acceptance, receipt, possession and/or use or misuse of any prize, and (B) have not made any warranty, representation, or guarantee express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose. However, nothing in these Official Rules shall limit or exclude the Sweepstakes Entities' liability for death or personal injury caused by its negligence or for any other matter where liability may not, as a matter of law, be limited or excluded.
Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, or stolen entries or prize notifications; or for lost, interrupted, inaccessible, or unavailable networks, servers, satellites, Internet service providers, websites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone, or cable transmissions; or for any technical malfunctions, failures, difficulties, or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. Sponsor reserves the right in its sole discretion to disqualify any individual who is found to be tampering with the entry process or the operation of the Sweepstakes, to be acting in violation of these Official Rules, or to be acting in an unsportsmanlike or disruptive manner, or with the intent to disrupt or undermine the legitimate operation of the Sweepstakes, or to annoy, abuse, threaten, or harass any other person, and Sponsor reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law. No mechanically reproduced, illegible, incomplete, forged, software-generated, or other automated multiple entries will be accepted. Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted, or that fraud or technical problems, failures or malfunctions, or other causes beyond Sponsor’s control have destroyed or severely undermined or to any degree impaired the integrity, administration, security, proper play, and/or feasibility of the Sweepstakes as contemplated herein. In the event Sponsor is prevented from awarding a prize or continuing with the Sweepstakes as contemplated herein by any event beyond its control, Sponsor shall have the right to modify, suspend, or terminate the Sweepstakes. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select winners in a random drawing from all eligible, non-suspect entries received as of the date of the event giving rise to the termination. Inclusion in such a drawing shall be each entrant’s sole and exclusive remedy under such circumstances. These Official Rules cannot be modified or amended in any way except in a written document issued by a duly authorized representative of Sponsor. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
GOVERNING LAW:
All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules or the rights and obligations of entrants or Sponsor in connection with the Sweepstakes shall be governed by and construed in accordance with the internal laws of the State of Texas, USA without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws.
PRIVACY AND DATA USE:
By entering the Sweepstakes, participants agree to Sponsor's use of their personal information as described in Sponsor's Privacy Policy, available at https://www.replicasurfaces.com/pages/privacy-statement.  Sponsor will not sell or share participants' information with third parties except as necessary to administer the Sweepstakes.
DISPUTE RESOLUTION:
By participating, entrants agree that any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action.
